Terms of Service

These Terms govern your use of the Shopify apps and services provided by Carlos Enrique Herrera Betancourt, a sole trader (autónomo) with Spanish tax ID (NIF) 54263611X, trading as "GetOptical" ("GetOptical", "we"), with address at Calle Arroyo 27, 41003 Seville, Spain. By installing or using an app, you agree to these Terms.

1. The service

GetOptical provides Shopify apps — including Optical Form — that let merchants offer prescription-eyewear and lens configuration on their store. We may update, improve or change features over time.

2. Plans, billing & free trial

Paid plans are charged through Shopify App Pricing, Shopify's managed billing: you choose and approve the plan on the pricing page Shopify hosts inside your admin, and the charge appears on your regular Shopify invoice. We charge a flat plan price and take no commission on your sales. You can upgrade, downgrade or cancel from within Shopify at any time.

Paid plans include a 14-day free trial. The trial starts when you choose and approve the plan in Shopify, not when you install the app: until you pick a plan no trial days are used up. Cancel before the trial ends and you are not charged.

3. Acceptable use

You agree to use the apps lawfully, not to misuse or attempt to disrupt the service, and to be responsible for the accuracy of prescription data collected through your store and for any regulatory obligations that apply to selling optical products in your market.

4. Intellectual property

GetOptical retains all rights to the apps and their code. You retain all rights to your store, content and customer data.

5. Disclaimers

The service is provided "as is". GetOptical is a software tool and does not provide medical or optometric advice; merchants are responsible for the validity of prescriptions and for fulfillment.

6. Limitation of liability

To the extent permitted by law, GetOptical is not liable for indirect or consequential damages. Total liability is limited to the fees paid in the 12 months before the claim.

7. Suspension & termination

You may uninstall the app at any time. We may suspend access for breach of these Terms.

No active subscription. If your store stops having an active subscription, access is not cut off immediately: there is a grace period of at least 3 days from the moment the lapse is confirmed, and during it we warn you inside the app itself and by email to your store's Shopify email address. After that, your configurators stop being displayed on your storefront and the app will not let you create or save forms. Nothing is deleted: your forms, settings and product assignments are kept exactly as they were, and they republish themselves as soon as the subscription is active again.

8. Data protection (data processor)

Where the app processes personal data of a merchant's customers (including prescription data, which may be special-category data), the merchant is the data controller and GetOptical acts as processor, processing such data only to provide the service and on your documented instructions. As processor (Art. 28 GDPR) we: (a) process data only under these Terms and your instructions; (b) ensure confidentiality; (c) apply appropriate security measures (TLS encryption, restricted access); (d) use only the sub-processors listed in the Privacy Policy, which is the current list; (e) assist you with data-subject requests and breaches; and (f) delete or anonymize the data when the service ends, honoring Shopify's mandatory redaction requests. This clause constitutes the data-processing agreement between the parties; if you need a separately signed DPA, contact us.

9. Changes & governing law

We may update these Terms; continued use means acceptance. These Terms are governed by Spanish law, and the GDPR (EU) 2016/679, the LOPDGDD (Organic Law 3/2018) and the LSSI-CE (Law 34/2002) apply. Any dispute shall be submitted to the courts of the provider's domicile, unless a mandatory rule provides otherwise.

10. Communications

We use your store's Shopify email address to send you service messages about the app: setup help (for example, if you stopped half-way through configuring it), a notice when a publish to your storefront fails, and notices about your subscription and its billing. These relate to an app you have installed: they are not marketing, and they never promote or sell anything else. If you would rather not receive them, reply to any of those emails and we will switch them off; uninstalling the app also takes you out of them.
